Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Prime Vitality Telehealth, LLC ("Prime Vitality," "we," "our," or "us"). By accessing our website at myprimevitality.com or enrolling in our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Eligibility

To use Prime Vitality's services, you must:

  • Be at least 18 years of age
  • Be a resident of the state of Utah or another state where we are licensed to practice
  • Provide accurate, current, and complete information during registration
  • Not have a medical condition that contraindicates the services offered

2. Nature of Services

Prime Vitality provides telehealth-based men's health services, including but not limited to testosterone replacement therapy (TRT), hormone optimization, and related treatments. Our services are provided by licensed healthcare providers operating within the scope of their licensure under Utah state law.

Important: Our services constitute medical care and involve prescription medications. All treatment decisions are made at the sole discretion of your licensed provider. Prime Vitality does not guarantee any specific outcome or result from treatment.

Not an Emergency Service

Prime Vitality is not an emergency medical service. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use our platform or messaging system for urgent or life-threatening situations.

3. Membership and Billing

Subscription Plans

Prime Vitality operates on a monthly membership model. By enrolling, you authorize us to charge your payment method on a recurring monthly basis at the rate corresponding to your selected plan.

Cancellation Policy

You may cancel your membership at any time by providing 30 days written notice to care@myprimevitality.com. You will continue to have access to services through the end of your current billing period. No refunds are issued for partial months.

Refund Policy

Membership fees are non-refundable once a billing cycle has begun. Fees paid for laboratory services or medications that have already been ordered or dispensed are non-refundable. Exceptions may be considered on a case-by-case basis at our sole discretion.

Price Changes

We reserve the right to modify our pricing with 30 days advance notice to active members. Your continued enrollment after the effective date of a price change constitutes your acceptance of the new pricing.

Insurance

Prime Vitality is a cash-pay practice and does not bill insurance. We are not responsible for any costs you incur attempting to seek insurance reimbursement. We can provide itemized receipts for HSA/FSA reimbursement upon request.

4. Patient Responsibilities

As a patient of Prime Vitality, you agree to:

  • Provide complete and accurate medical history and symptom information
  • Disclose all current medications, supplements, and treatments
  • Follow the treatment plan as prescribed by your provider
  • Attend required follow-up consultations and lab appointments
  • Notify your provider immediately of any adverse reactions or side effects
  • Not share, sell, or transfer any prescribed medications to others
  • Comply with all applicable federal, state, and local laws regarding controlled substances
  • Maintain a secure login and notify us immediately of any unauthorized account access

5. Prescription Medications

Testosterone and certain other medications prescribed by Prime Vitality providers are controlled substances regulated by the DEA and Utah state law. By receiving a prescription through Prime Vitality, you acknowledge that:

  • Medications are prescribed solely for your personal therapeutic use
  • Distribution, sharing, or diversion of controlled substances is a federal crime
  • You will store medications securely and out of reach of minors
  • Prescriptions may be discontinued at any time at the provider's clinical discretion

6. Limitations of Telehealth

Telehealth services have inherent limitations compared to in-person care. You acknowledge that:

  • Your provider cannot perform physical examinations
  • Technical failures may interrupt or delay care
  • Certain conditions may require referral to in-person care
  • Your provider may determine at any time that telehealth is not appropriate for your situation

7. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or that any specific medical outcome will be achieved. Individual results vary and are not guaranteed.

8. Limitation of Liability

To the fullest extent permitted by law, Prime Vitality, its owners, officers, providers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Prime Vitality and its affiliates from any claims, damages, losses, or expenses (including attorney's fees) arising out of your violation of these Terms, your misuse of our services, or your violation of any applicable law.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Salt Lake County, Utah, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify active members of material changes via email at least 14 days before the changes take effect. Your continued use of our services constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, misrepresentation of medical information, non-payment, or for any reason at our sole discretion. Upon termination, your right to access our services ceases immediately.
